Lawsuit Against Diamond’s Gentlemen’s Club Regarding Letting Homatas Drive Drunk Settled for $1 Million

The lawsuit against a Diamond’s Gentlemen’s Club, a West Chicago strip club has been settled for $1 million with $800,000 going to Ryan Simmons, husband of April Simmons, and $200,000 to the family of John Chiariello.

In January 2006, John Homatas and John Chiariello left Diamond’s after Diamond’s employees put Homatas in the driver’s seat of his car when he was found vomiting in the strip club’s bathroom. About 15 minutes later Homatas car crashed head-on into an SUV driven by April Simmons. The crash killed Homatas’ passenger John Chiariello, and the SUV driver April Simmons, and her unborn child.

Since the club argued that they did not bear responsibility for the crash because they do not serve alcohol. The Illinois Supreme Court ruled in March that Diamond’s did bear some responsibility for the crash. The Supreme Court ruling led to talks between the defendant and the plaintiffs. The settlement was then finalized on July 23.

The clubs maximum insurance amount on the insurance policy was $1 million.

John Homatas, 29, is serving a 12-year prison term for aggravated DUI and reckless homicide. He was found guilty following a 2007 trial in Kane County court.

DUI Charges Likely to Be Dropped for Chris Chelios After Judge Views Police Video

Video and audio from Westmont Police Department dashcam showing a 3:54 a.m. traffic stop and arrest of Chris Chelios obtained by Daily Herald.

Former Chicago Blackhawks star Chris Chelios was arrested early December 28, 2009 and charged with speeding and DUI, Westmont police said. But the defense attorney for Chris Chelios says that the video of the traffic stop and sobriety tests shows that Chelios was not impaired.

According to police, Chelios, now playing for the Chicago Wolves, was driving at a high speed in a pickup truck east on Ogden Avenue in the area of Blackhawk Drive in Westmont when he was stopped. He also crossed a center line a couple of times, according to police.

“Can’t you just let me go home, please? I’m safe. I’m not a danger,” Chelios asked on the video. The Westmont officer refused.

Chelios declined to take a breath test.

Chelios was then taken to the Westmont Police Department Headquarters, where he was charged and later released on bond.

On Wednesday February 10, 2010 Judge Cary Pierce ruled after viewing a 15-minute police videotape showing the Dec. 28 traffic stop and sobriety tests that Westmont police lacked probable cause to arrest Chelios following the December 28 traffic stop.

Next step is for the defense to ask the charges be dropped. That request is likely to be granted, according to the defense attorney handling the defense.

DUI Dashcam Video of Wisconsin Representative Jeffrey Wood Traffic Stop

Raw video: Dashcam catches Wisconsin state lawmaker Jeffrey Wood tumbling to ground during sobriety test in Tomah, Wisconsin.

Police squad car video on a traffic stop at Interstate 39 north of Highway NN in Rib Mountain shows Wisconsin lawmaker Rep. Jeffrey Wood falling down during a sobriety test that led to his third arrest in less than a year on suspicion of driving under the influence.

The video, which was released Tuesday October 27, 2009 by Tomah police, shows Rep. Jeffrey Wood getting pulled over after police saw a Buick Skylark stop in the middle of a road and then slowly swerve across both lanes of traffic — probable cause for DUI.

Wisconsin State Patrol troopers found Wood 6:39 p.m. Wednesday September 23, 2009 after they were notified that a motorist was driving recklessly in Portage County. A witness following the vehicle told authorities she saw the car hit a curb and almost crash into another vehicle.

After the traffic stop and during a field sobriety test, Wood was asked to walk a straight line. Wood stumbled backward into the trunk of his car before falling down to the ground. A Tomah police officer helped him up, and put Wood in handcuffs.

Police also seized bottles of prescription drugs from Wood. He was charged last week with a third offense of operating under the influence of an intoxicant, and bail jumping.

In 2008 Wood was arrested on suspicion of drunk driving. His BAC was more than double the legal limit following an accident in which his car reportedly became airborne. Marijuana was found in Wood’s vehicle after the accident.

The Wisconsin jurisdiction uses the term OWI — Operating while intoxicated.
