A person whose identity was not released called Geneva police the Thursday night, January 28 to request a well-being check at the Gutierrez home. Police found Eduardo Gutierrez, age 53, dead at the home, and Julia Gutierrez, his wife, needing medical treatment. She was transported to a hospital by paramedics.

Following a police investigation, Julia L. Gutierrez, 53, was charged with first-degree murder, and has been held in Kane County jail (Kane County Adult Justice Center) without bail since about 2:00 p.m. Sunday, January 31, 2016. The Kane County state’s attorney’s office accused Julia Gutierrez of putting the prescription drug Temazepam into a beverage and giving it to her husband sometime between Tuesday, January 26th and Thursday, January 28th, 2016. Neither the husband or wife had previous criminal charges or any active orders of protection in Kane County.
Temazepam is the generic version of the sleeping pill Restoril, indicated for short-term prescription to treat insomnia.

Eduardo Gutierrez was busy in ministries and church activities at the North Aurora Seventh-day Adventist Church. His activities also included volunteering for charity food collections and blood donations. Gutierrez worked as a handyman, and had recently taken over running his deceased brother’s coin shop in Rock Falls.
Visitation for Eduardo Gutierrez is 4 to 8 p.m. Thursday at Conley Funeral Home, 116 W. Pierce St., in Elburn, Illinois. The memorial service is noon Friday at North Aurora Seventh-day Adventist Church, 950 Mooseheart Road.
