Kane County State’s Attorney Jamie L. Mosser and Batavia Chief of Police Eric Blowers announced on Wednesday, December 24, 2025 that Hector B. Luvianos is charged with first-degree murder, a class M felony.
On December 24, 2025, the defendant was brought to court for a pretrial detention hearing, during which the State argued for his detention. Granting the State’s petition, the court ordered the defendant detained in the Kane County jail while his case is pending.
State’s Attorney Mosser alleges that on Tuesday, December 23, 2025, at approximately 4:37 a.m.., the Batavia Police Department was dispatched to an apartment building in the block of 100 Church Street for a male subject who was reporting to dispatchers that he had just killed his wife. Responding officers located the male just outside of the apartment. Hector B. Luvianos was taken into custody without incident. When police officers entered the apartment, they located a female victim with significant, life-threatening injuries. First responders attempted to render aid to the victim, but she was ultimately pronounced dead at the scene. The subject who was taken into custody was identified as Hector Luvianos, a 37-year-old male and Batavia resident. Luvianos was transported to the Batavia Police Department by Batavia police officers.
With the help of the Kane County Major Crimes Task Force, the department initiated a comprehensive investigation. The investigation revealed that this was a domestic-related incident involving two subjects and that there is no indication of an ongoing threat to the community, according to the Kane County State’s Attorney’s Office.
The Kane County Coroner’s Office was requested to the scene, and an autopsy will be conducted to determine the exact cause and manner of death.
The Batavia Police Department is encouraging anyone who might have information regarding this incident to contact the Batavia Police Department Investigations Division at (630) 454-2500.
The charges against the defendant are not proof of guilt. The defendant is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove guilt beyond a reasonable doubt.
