Mundelein Man from Arlington Heights Claims Traffic Stop Lacked Grounds For Police Search, Heroin Find

Matthew D. Graff, a man recently living in Mundelein and charged with possession of heroin, is asking a judge to throw out all evidence collected by Mundelein police.

Matthew D. Graff, 31, of the block of 1000 East Orchard Street Apt. #102, Mundelein, was charged October 8, 2014 with possession of a controlled substance and possession of a controlled substance with intent to deliver. A police report claims Graff told officers he would soon travel to Chicago to pick up more bags for delivery.

Graff has been in jail four months since the arrest, and was accepted into an outpatient drug rehabilitation program, which included supervision by a Lake County Sheriff’s Deputy during each visit until Graff returned to jail.

Police documents obtained through the circuit clerk’s office show police officers stopped Graff for a traffic violation, and conducted a search during the traffic stop. Police found 32 small bags in Graff’s front and back pants pockets. Each bag contained a substance that tested positive for heroin, according to Mundelein Police Department.

According to a defense motion filed January 27, 2015, police stopped Graff for failing to signal while changing lanes, which Graff’s attorney argues did not constitute grounds for a search. The motion is expected to be heard February 25, 2015.

Court records show that Graff’s criminal history has numerous prior convictions dating back to 2002, including retail theft, drug possession and residential burglary.

Records show Graff only lived in Mundelein for a few weeks prior to his arrest October 8, 2014. Previously he lived with his parents in Arlington Heights.

After February 25, 2015, Graff’s next scheduled court date is a pretrial hearing on March 30, 2015.
