DuPage County State’s Attorney Robert Berlin and West Chicago Chief of Police Colin Fleury announced that Judge Joshua Dieden granted the State’s motion to deny pre-trial release for a North Aurora man accused of shooting at a moving vehicle last November. Javier Munoz, age 20, of the 0-99 block of South Sycamore Lane in North Aurora, appeared in First Appearance Court Thursday afternoon, March 18, 2026 charged with two counts of Aggravated Discharge of a Firearm (one Class X Felony and one Class 1 Felony).

Police officers with the West Chicago Police Department responded about 6:43 p.m. on Friday, November 7, 2025, for a report of shots fired in the parking lot at the Timberlake Apartment Complex, 1220 S. Kings Cross in West Chicago. Following an investigation by the West Chicago Police Department, there was a black Ford Explorer with two occupants, a mother and her sixteen-year-old child. The driver of the Ford Explorer drove to the north portion of the center parking lot and remained there for approximately ten seconds when a subject, later identified as Munoz, exited from a building at the 1220 Kings Cross address, and began walking in the direction of the Ford Explorer. The driver of the Ford Explorer began driving slowly and Munoz started jogging to catch up to it. Munoz allegedly began shooting a handgun at the rear of the Ford as the driver continued to drive in the parking lot. After the shooting, Munoz entered the 1221 Kings Court building. The alleged shooting took place within 1,000 feet of an elementary school. When processing the scene, authorities found that the shots allegedly fired by Munoz damaged the Ford Explorer and shattered a nearby patio door. Additionally, authorities recovered five spent shell casings in the parking lot area. On March 6, 2026, Judge Jeffrey MacKay issued an arrest warrant for Munoz. He was taken into custody on March 18, 2026.

“The allegations that Mr. Munoz opened fire on a vehicle with two occupants in a public parking lot within one thousand feet of a school are extremely disturbing and will be met with the full force of the law. Thankfully, neither of the occupants of the vehicle or any other innocent bystanders were injured as a result of Mr. Munoz’s alleged behavior. This type of blatant disregard for public safety and the rule of law, as alleged in this case, will not be tolerated in DuPage County. I thank the West Chicago Police Department for their thorough investigation into this matter and for their continued efforts in keeping our neighborhoods safe. I also thank Assistant State’s Attorney Denis Cahill for his efforts in securing charges against Mr. Munoz.”

— DuPage County State’s Attorney Robert B. Berlin

“The discharge of a firearm in any residential area, such as the Timberlake Apartment Complex, demonstrates a profound disregard for the safety of our residents. The West Chicago Police Department remains dedicated to investigating these acts thoroughly. Removing those who compromise the peace of our neighborhoods is a top priority for our officers. I thank State’s Attorney Bob Berlin and his team for their guidance on this case and for their continued support of law enforcement.”

— West Chicago Chief of Police Colin Fleury

Munoz’s next court appearance is scheduled for arraignment on April 13, 2026, in front of Judge Joseph Bugos.

Members of the public are reminded that this complaint contains only charges and is not proof of the defendant’s guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt.
