State Rep. Justin Slaughter (D-Chicago) Sponsors Bill That Would Amend Vehicle Code, Limit Police Authority for Traffic Stops

Illinois State Rep. Justin Slaughter (D-Chicago/27th District) is sponsoring House Bill HB4603 that would limit police authority for traffic stops and the admissibility of information forthcoming from traffic stops.

Rep. Slaughter, is also one of the lead advocates of the Illinois’ Safe-T Act, which has been criticized by county sheriff’s, state’s attorneys, and some judges for releasing dangerous defendants into society before trial.




The 27th District covers an area from the far southside of Chicago to some Southwest Cook County suburbs; including the Auburn Gresham, Brainerd Park, Longwood Manor, Princeton Park, Beverly, Morgan Park, Roseland, Washington Heights, West Pullman neighborhoods of Chicago, the southwest suburbs of Alsip, Blue Island, Crestwood, Merrionette Park, Midlothian, Orland Park, Palos Heights, Palos Park, and Robbins.

House Bill HB4603 amends the Illinois Vehicle Code. Provides that no law enforcement officer shall stop a motor vehicle for:

(i) failing to display registration plates or stickers;

(ii) being operated with an expired registration sticker;

(iii) violating general speed restrictions (unless that violation is a misdemeanor or felony offense);

(iv) improper lane usage (unless that violation is a misdemeanor or felony offense);

(v) failing to comply with certain requirements concerning vehicle lamps;

(vi) excessive tint;

(vii) defective mirrors;

(viii) an obstructed windshield or defective windshield wipers;

(ix) defective bumpers;

(x) excessive exhaust; and

(xi) failure of the vehicle operator to wear a safety belt.

The bill provides that no evidence discovered or obtained as the result of a stop in violation of these provisions, including, but not limited to, evidence discovered or obtained with the operator’s consent, shall be admissible in any trial, hearing, or other proceeding. The bill also preempts home rule powers.

The bill basically ads the following text to multiple sections to amend the vehicle code …

No law enforcement officer shall stop a motor vehicle for a violation of this Section. No evidence discovered or obtained as the result of a stop in violation of this subsection, including, but not limited to, evidence discovered or obtained with the operator’s consent, shall be admissible in any trial, hearing, or other proceeding. A home rule unit may not regulate motor vehicles in a manner inconsistent with this subsection. This subsection is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.

According to Slaughter’s candidate website, “as a college student, Representative Slaughter experienced his first endeavors into public service as an intern for U.S. Congressman Bobby Rush (IL-1st District); and later for then 6th Ward Chicago Alderman Freddrenna Lyle.”

Slaughter also worked in the administration of Cook County Board President, Toni Preckwinkle; first as a Special Assistant in the Bureau of Administration and then as a Legislative Coordinator for the Secretary to the Board of Commissioners.
