Illinois Officials Appeal DuPage County and Naperville Decision to Allow Police to “Double Dip” with Salary and Pension

The Chicago Tribune reported on Friday, April 11, 2014 that State of Illinois officials are fighting to suspend police pension collection by Naperville Police Chief Bob Marshall while he works and collects salary as Naperville Police Chief.

Police Chief Marshall spent 28 years with the Naperville Police Department before retiring in 2005. Then he became Naperville’s assistant city manager. In May 2012 he returned to the Police Department as chief, and kept collecting his police pension while contributing the separate pension system where he contributed funds — Illinois Municipal Retirement Fund.

In continuing the fight of so-called “double dipping” the Illinois attorney general’s office this week filed an appeal of DuPage County Associate Judge Paul Fullerton ‘s ruling that strangely concluded that police Chief Bob Marshall doesn’t count as a police officer for pension purposes.

With the DuPage County judge’s ruling, Marshall receives a salary of $154,775 from the police department as well as his annual police pension, which currently stands at $104,109 — a total of $ 259,884.

Shortly after the judge’s ruling, the Illinois Department of Insurance filed a position statement arguing that Marshall should not continue to receive his police pension along with the salary. The Naperville Police Pension Fund Board proceeded and voted 4-1 in January 2013 reaching a decision that Marshall could collect both.

Chicago Superintendent of Police Garry F. McCarthy’s annual salary is 260,004, according to the City of Chicago official police website.

Next, the State of Illinois officials will appeal the decision in the Illinois 2nd District Appellate Court.
