DuPage County State’s Attorney Robert Berlin and Naperville Chief of Police Jason Arres announced today, Friday, January 2, 2025, that an Arizona resident has been charged with stealing multiple cell phones from the Naperville Apple Store, located at 120 West Jefferson Avenue. Khyree Mosley, age 24, of Chandler, Arizona, was released on his own recognizance earlier this morning after being charged with one count of Burglary (Class 2 Felony), one count of Retail Theft (Class 3 Felony) and one count of Misdemeanor Fleeing or Attempting to Elude a Police Officer.
Mosley entered the Apple Store on Thursday, January 1, 2026 at approximately 4:25 p.m., and allegedly selected three Apple iPhone 17 Pro Max 1TB phones, and left the store without paying for the merchandise. Mosley allegedly fled the scene in a white Chevrolet Equinox. When a Naperville police officer, driving a fully-marked police SUV, activated the emergency lights and signaled for Khyree Mosley to stop, Mosley fled the police officer. Later, at approximately 9:00 p.m. Thursday night, police officers with the Minooka Police Department located Mosley and took him into custody.
“Make no mistake, even though the holiday season is now in the rear-view mirror, law enforcement in DuPage County remains vigilant and we will continue to go after those who mistakenly believe they can come here, help themselves to whatever they like and simply leave. Burglary and retail theft are not victimless crimes. We all bear the cost in the form of higher prices, lost revenue and wages, reduced local economic investment and a lost sense of security. I thank the Naperville Police Department for their work on this case and for their ongoing efforts in keeping our retail establishments safe for employees and patrons. I also thank Assistant State’s Attorney Kevin Kosman for his work in securing charges against Mr. Mosley.”
— DuPage County State’s Attorney Robert B. Berlin
“Our message is simple: if you commit crimes in Naperville, you will be held accountable. This case reflects the persistence and diligence of our officers, as well as the importance of strong partnerships with neighboring agencies. We remain committed to protecting our businesses, their employees, and our community, and we will not tolerate behavior that threatens public safety. I would like to extend thank-yous to the Minooka Police Department for their work in locating and arresting the suspect, as well as State’s Attorney Bob Berlin and his staff for working with us to secure these charges.”
— Naperville Chief of Police Jason Arres
The next court date Mosley is scheduled for February 11, 2026, in front of Judge Margaret O’Connell.
Members of the public are reminded that this complaint contains only charges and is not proof of a defendant’s guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt.
