A check by local police discovered that the suspect allegedly had three previous DUI arrests.

Police received a report that an intoxicated unknown male was causing a disturbance and was leaving the area in a white van westbound on Oakton Street from Center Street.

Police upon arrival located the white van and observed the driver make a lane change without a turn signal. Police continued to follow the van as the driver continued westbound Oakton Street and then southbound on Webster Lane. The driver was observed weaving on both sides of the unmarked street.

When police asked Kelly for his driver’s license and proof of insurance, he admitted that his driving license was revoked. Police detected a strong odor of alcohol emitting from his breath, and observed he had watery/bloodshot eyes, a flushed face, and that he was slurring and mumbling his speech.

The officers asked Kelly if he had consumed alcohol prior to driving, and Kelly replied he had consumed alcohol. Police confirmed that Kelly’s driver’s license status was revoked by the Illinois Secretary of State.

Following a field sobriety test and his refusal to take a breathalyzer test, Kelly was taken into custody suspected of DUI. Police also located two bottles of vodka next to the driver’s seat.

Kelly was transported to the Des Plaines Police Station and his vehicle was towed to a police holding area. At the police station he refused to submit to a breathalyzer test and blood sample tests to determine his blood alcohol content.

Des Plaines police discovered that Kelly had three previous DUI arrests, and subsequently The Cook County State’s Attorney’s Office approved felony charges for Aggravated Driving Under the Influence of Alcohol. Kelly was also charged with Driving Under the Influence of Alcohol and Driving on a Revoked License.
