Ruling: Tomah, Wisconsin Police Shooting of Suspect in Drive-By Shootings in Illinois, Wisconsin Justified

Warning: shootout shown. Police officers in Tomah, Wisconsin were cleared of any wrongdoing Tuesday after a gunfight with a suspect ended in his death. (May 4)

Tomah, Wisconsin police about 6:30 p.m. Friday, April 22, 2011 at Kilbourn Avenue and Saratoga were following a suspect in a drive-by shooting near Bloyer Airfield and initiating a traffic stop, when the driver Seth M. McCloskey, 28, of a red pickup truck exited the driver’s side door of the truck with his weapon raised and firing. Police returned multiple shots as the driver got back into his rolling truck, which came to rest near the southeast corner of Saratoga Street and Woodard Avenue. A two-hour standoff followed and the suspect was then discovered dead in his pickup truck.


During the shootout, Tomah police Josh Kenworthy was shot in the left foot. He was later released.

McCloskey, of Ohio, had a prior criminal history in other states.

Tomah Police are in contact with other law enforcement agencies in Dane County, Rock County and the State of Illinois, to determine whether or not the drive-by shooting that occurred in the City of Tomah on April 22, 2011 is related to other recent drive-by shootings.

Police are urging citizens with information about a drive-by shooting into a house near Bloyer Airfield to contact police. Police originally received a report about 1:40 p.m. Friday from people at the house near Bloyer Airfield where a bullet had been fired into the house. Police leaned three bullets had been fired into the house and recovered two of the bullets. No one was injured.

  1. The guy got out of his pickup thinking he was a bad ass and shooting at police (first clue this guy wasn’t too bright). Then he forgets to put his vehicle in park before he starts shooting. Glad the injuries suffered by police were minor.
